City Council minutes for June 27, 2009

A regular meeting of the Alabaster City Council was held in the Municipal Annex on Thursday, June 4, 2009, at 7:00 P.M., and there were present at said meeting Councilpersons: Present: Jim McClain, Sophie Martin, Bob Hicks, Adam Moseley, Rick Walters, Scott Brakefield and Tommy Ryals.

MEETING OPENING

The meeting was opened with prayer followed with the Pledge of Allegiance.

After an abbreviated reading of the minutes, Council Member Walters made a motion to approve the minutes of the May 21, 2009 meeting. Council Member Moseley seconded the motion. Voting - Ayes: All Ayes. Nays: None. Motion carried.

Council Member Ryals made a motion to approve the agenda for tonight’s meeting with the addition of one item, consideration of Resolution No. 060409-Z001 regarding the show cause hearing matter of Lacey’s Grove Phase 1 & 2. Council Member Hicks seconded the motion. Voting - Ayes: All Ayes. Nays: None. Motion carried.

MAYORS COMMENTS

Mayor Frings recognized and thanked the Alabaster Arts Council, sponsors, and all the volunteers for their hard work preparing for City Fest 2009.

Mayor Frings proclaimed June 15, 2009 as “Elder Abuse Awareness Day” and encouraged all of our citizens to recognize and celebrate the value of Alabaster’s seniors and disabled adults and their right to live safely in their community.

COUNCIL REPORTS

Council Member Hicks gave the Fire Department Report for the month of May 2009.

Council Member Hicks gave the Police Department Report for the month of May 2009.

Council Member Walters gave the Library Report for the month of May 2009.

Council Member Ryals gave the Building Safety Report for the month of May 2009.

ORDINANCE NO. 09-001

1. A PUBLIC HEARING ON AN ORDINANCE REGARDING COLLECTION SYSTEMS REGULATIONS.

Council Member Ryals introduced Ordinance No. 09-001 regarding the addition of sanitary sewer design, construction and testing specifications to our current regulations.

Council President McClain opened the public hearing up to the floor for those wishing to speak either for or against said ordinance. No one spoke for or against said regulations. However, Council Member Walters said he is concerned about the additional costs he feels this would create. Council Member Ryals made a motion to adopt Ordinance No. 09-001 with Council Member Moseley seconding. Voting - Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: Rick Walters. Motion carried.

ORDINANCE NO. 09-003

2. PUBLIC HEARING ON AN ORDINANCE TO ADOPT NEW BUILDING AND LIFE SAFETY CODES.

Council Member Hicks introduced said ordinance regarding adoption of the new building and life safety codes for 2009. Council President McClain opened the public hearing up to the floor for those wishing to speak either for or against said ordinance. Brooks Harris with the Greater Birmingham Area Home Builders spoke against said ordinance due to his concerns about the additional costs associated with the addition of sprinkler systems to a single family residence included in the new code adoption. Steve Sims, Building Official, spoke in favor of the new codes. Frank Matherson, Fire Chief, spoke in favor of the new codes and stated that effective January 1, 2011 the installation of sprinklers becomes a national standard and it does save lives. Council Member Hicks made a motion to continue this item until the June 18, 2009 meeting. Council Member Brakefield seconded. Voting - Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Rick Walters, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Motion carried.

ORDINANCE NO. 09-002

3. A PUBLIC HEARING ON AN ORDINANCE TO AMEND THE LAND DISTURBANCE/EROSION CONTROL ORDINANCE.

Council Member Moseley introduced said ordinance regarding amending Ordinance No. 06-013 requiring erosion control prevention measures for any land disturbance activities to properly read Section 50-44 in lieu of 54-40. Council President McClain opened the public hearing up to the floor for those wishing to speak either for or against said ordinance. No one spoke in favor or against said ordinance. Council Member Moseley made a motion to adopt Ordinance No. 09-002 with Council Member Martin seconding. Voting - Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Rick Walters, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Motion carried.

RESOLUTION NO. 060409-A

4. RESOLUTION ALLOWING MAYOR TO ENTER INTO A CONTRACT WITH SHELBY COUNTY TO PROVIDE UPDATED TOPOGRAPHIC MAPPING FOR OUR BUILDING/PLANNING DEPARTMENT.

Council Member Ryals introduced Resolution No. 060409-A, and made a motion to approve said Resolution allowing Mayor Frings to enter into a contract with Shelby County to provide updated topographic mapping. The total project as stated in the contract is not to exceed $38,850.00 to be paid in next year’s budget. Council Member Hicks seconded. Voting - Ayes: Bob Hicks, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: Sophie Martin, Adam Moseley and Rick Walters. Motion carried.

RESOLUTION NO. 060409

5. RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH SHELBY COUNTY FOR PARKS & RECREATION GRANT FUNDS.

Council Member Brakefield introduced Resolution No. 060409, and made a motion to approve said Resolution allowing Mayor Frings to enter into a contract with Shelby County for grant funds of $15,000 to help cover the expenses associated with the ACCCS softball tournament held at Veterans Park and $2,000 to help with City Fest.

Council Member Walters seconded. Voting - Ayes: Bob Hicks, Rick Walters, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Sophie Martin and Adam Moseley abstained due to their being on the Alabaster Arts Council. Motion carried.

6. SET A PUBLIC HEARING ON A RE-ZONING REQUEST FOR 21.7 +/- ACRES OF CITY OWNED PROPERTY TO INSTITUTIONAL ZONING.

Council Member Martin made a motion to set said public hearing on July 16, 2009 with Council Member Moseley seconding. Voting - Ayes: All ayes. Nays: None. Motion carried.

7. SET PUBLIC HEARINGS (3) ON RECOMMENDATIONS FROM PLANNING AND ZONING BOARD ON SHOW CAUSE ACTIONS.

Council Member Ryals made a motion to set said hearings (3) on July 16, 2009 with Council Member Walters seconding. Voting - Ayes: All ayes. Nays: None. Motion carried.

RESOLUTION NO. 060409-Z001

8. A RESOLUTION REGARDING PLANNING AND ZONING RECOMMENDATIONS ON LACEY’S GROVE, PHASE 1 & 2.

Council Member Ryals introduced Resolution No. 060409-Z001 finding that the roads in Lacey’s Grove, Phase 1 & 2 have not been satisfactorily installed and the developer has not met the extension given to resolve these issues. Council Member Ryals made a motion to approve Resolution No. 060409-Z001 finding that the roads in Lacey’s Grove, Phase 1 & 2 have not been satisfactorily installed and after being given 45 days on April 2, the developer has not resolved this issue to the specifications or the set time frame given by the Council at that time. Therefore, Council is authorizing Mayor Frings to take any and all legal action necessary to bring the roads into compliance, including the institution of litigation against Lacey’s Grove, LLC and its bonding companies. Also, stating that nothing herein shall be deemed as accepting the roadways of Lacey’s Grove, Phase 1 & 2 for public maintenance and repair.

Council Member Moseley seconded. Voting - Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Rick Walters, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Motion carried.

COUNCIL WORK SESSION

Council President McClain announced that a council work session will be held on Wednesday, June 10, 2009 at 6:30 P.M. in the conference room at the City Services Building, 10052 Highway 119 South.

MEETING CLOSING

After brief council and audience comments, Council Member Walters made a motion to adjourn with Council Member Brakefield seconding. All were in favor and said meeting was adjourned at 7:46 P.M.
