City Council minutes for May 9, 2009

A regular meeting of the Alabaster City Council was held in the Municipal Annex on Thursday, April 16, 2009, at 7:00 P.M., and there were present at said meeting Councilpersons: Present: Jim McClain, Sophie Martin, Bob Hicks, Adam Moseley, Scott Brakefield and Tommy Ryals. Absent: Rick Walters.

MEETING OPENING

The meeting was opened with prayer followed with the Pledge of Allegiance.

After an abbreviated reading of the minutes, Council Member Moseley made a motion to approve the minutes of the April 2, 2009 meeting. Council Member Hicks seconded the motion. Voting – Ayes: All Ayes. Nays: None. Motion carried.

Council Member Moseley made a motion to approve the agenda for tonight’s meeting, as written. Council Member Ryals seconded the motion. Voting – Ayes: All Ayes. Nays: None. Motion carried.

MAYORS COMMENTS

Mayor Frings recognized several members of the Police Department for their hard work and dedication involving a couple of matters recently, one involving a car accident this past Sunday morning with a fatality. He also thanked the U. S. Marshals Office and commended both departments for having such a good working relationship.

Mayor Frings advised that he has received several letters from the students at Meadow View Elementary School for the recent enrichment grants they received from the City. Mayor Frings read one of the letters to the Council and audience.

Mayor Frings proclaimed May 1 as “Silver Star Banner Day”, the permanent and official day to honor the wounded and ill servicemen and women of the City of Alabaster.

Mayor Frings proclaimed the month of April, 2009 as “Child Abuse Prevention Month” in Alabaster.

Mayor Frings proclaimed the month of April, 2009 as “Sexual Assault Awareness Month” in Alabaster.

Mayor Frings announced to the Council and audience that former Mayor Steven Rauch’s wife, Becky, passed away a few hours ago.

COUNCIL REPORTS

Council Member Martin gave the Library Report for the month of March 2008.

Council Member Hicks gave the Fire Department Report for the month of March 2008.

Council Member Hicks gave the Police Department Report for the month of March 2008.

Council Member Ryals gave the Building Safety Department Report for the month of March 2008.

RESOLUTION NO. 041609

1. A RESOLUTION REGARDING WAIVING BUSINESS LICENSE FEES FOR VENDORS AT THE ONE DAY EVENT OF CITY FEST 2009.

Council Member Ryals made a motion to approve Resolution No. 041609 waiving all city business license fees from vendors for the one-day event of City Fest 2009. Council Member Hicks seconded. Voting – Ayes: Bob Hicks, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Sophie Martin and Adam Moseley abstained. Motion carried.

RESOLUTION NO. 041609-A

2. BIDS ON (5) CAMERA SYSTEMS FOR NEW POLICE CARS.

Council Member Hicks made a motion to approve Resolution No. 041609-A awarding the low bid of $21,375.00 to Brasher Electronics, Inc. for five camera systems for the new police cars purchased recently. Council Member Moseley seconded. Voting – Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Motion carried.

RESOLUTION NO. 041609-B

3. RESOLUTION ON CONTRACT FOR PHYSIO-CONTROL, INC. FOR FIRE DEPT.

Council Member Brakefield introduced Resolution No. 041609-B, and made a motion to approve said Resolution allowing Mayor Frings to enter into a contract with Physio-Control, Inc. to provide designated covered equipment and/or software as listed on Schedule A and services as set out in detail within said contract for the Lifepak 12 Defibrillator/Monitors for the Fire Department. Council Member Martin seconded. Voting – Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Motion carried.

4. A LICENSE APPLICATION FOR A (040) RETAIL BEER (ON OR OFF PREMISES) FOR PATIO GRILL, 9330 HIGHWAY 119, SUITE 400.

Council Member Martin made a motion to approve said application from the Patio Grill, for a (040) Retail Beer (on or off premises) license at 9330 Highway 119, Suite 400. Council Member Brakefield seconded. Voting – Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Motion carried.

5. SET A PUBLIC HEARING ON AN ORDINANCE REGARDING COLLECTION SYSTEMS REGULATIONS.

Council Member Ryals made a motion to set said public hearing on May 7, 2009 on an Ordinance Regarding Collection Systems Regulations with Council Member Brakefield seconding. Voting – Ayes: All Ayes. Nays: None. Motion carried.

RESOLUTION NO. 041609-C

6. RESOLUTION REGARDING ALDOT CONTRACT FOR RIGHT OF WAY MAINTENANCE ON HIGHWAY 31 AND 119.

Council Member Ryals introduced Resolution No. 041609-C, and made a motion to approve said Resolution allowing Mayor Frings to enter into a contract with the Alabama Department of Transportation regarding the continued beautification and cooperative maintenance of public right of way as it relates to U. S. 31 and S.R. 119. Council Member Moseley seconded. Voting – Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Motion carried.

RESOLUTION NO. 041609-D

7. RESOLUTION IN RECOGNITION OF WILLIE B. ARRINGTON.

Council Member Martin introduced Resolution No. 041609-D, and made a motion to approve said Resolution recognizing one of our citizens, Mr. Willie B. Arrington, for the many years of dedicated service to this City and this community by placing a memorial sign in his honor at 5th Avenue Southeast. Council Member Moseley seconded. Voting – Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Motion carried.

RESOLUTION NO. 041609-E

8. BIDS ON TWO EMERGENCY WEATHER SIRENS.

Council Member Hicks introduced Resolution No. 041609-E and made a motion to approve said Resolution rejecting the two bids received on March 24, 2009 for two emergency weather sirens due to both exceeding the amount set out in the FEMA Grant that was to assist in purchasing said sirens. Council Member Moseley seconded. Voting – Ayes: Sophie Martin, Bob Hicks, Adam Moseley, Scott Brakefield, Tommy Ryals and Jim McClain. Nays: None. Motion carried.

COUNCIL WORK SESSION

Council President McClain announced that no council work session would be held before their next regularly scheduled meeting.

MEETING CLOSING

After brief council and audience comments, Council Member Moseley made a motion to adjourn with Council Member Brakefield seconding. All were in favor and said meeting was adjourned at 7:36 P.M.
